TERMS & CONDITIONS

All information contained herein is subject to change without notice. Buyer’s acceptance of delivery of the
product constitutes acceptance of these Terms & Conditions. Any additional or different terms proposed by
Buyer are hereby rejected in their entirety unless expressly agreed to in writing by Seller’s authorized
representative.

TERMS OF PAYMENT

Accepted payment methods include prepaid, Visa, and MasterCard. Net 30-day terms from the invoice date are available upon approved credit.

Accounts with past-due invoices will be placed on credit hold. A finance charge of 1.5% per month (or the maximum permitted by law) will be applied to all past-due balances.

Accounts are considered paid in full only upon receipt by estimatedwebsite Performance Inc. of the full invoice amount, including any applicable collection fees and expenses.

A minimum fee of $35 will be charged for NSF checks, stop payments, chargebacks, or similar occurrences.

No deductions or credits may be taken without a valid credit memo issued by estimatedwebsite Performance Inc.Unauthorized deductions will result in the account being placed on credit hold.

Special order products require a 50% deposit and are non-cancelable and non-returnable.

DROP SHIPMENTS & REFUSED PACKAGES

Drop shipments are subject to a $30 service fee.

If a shipment is refused, the ordering party will be responsible for:

• All shipping charges
• A 20% restocking fee

International drop shipments are not available.

RETURNS

All returns require prior authorization from estimatedwebsite Performance Inc. Once approved, a Return Merchandise Authorization (RMA) number will be issued.

• The RMA number must appear on all cartons and shipping documents
• Returns must be shipped prepaid (collect shipments will be refused)
• Products that are used, modified, or installed are not eligible for return

Returns must be made within 90 days of the invoice date and are subject to a 20% restocking fee. No returns will be accepted after 90 days.

Shipping charges are non-refundable unless the product is deemed defective by estimatedwebsite Performance Inc.

Special order items are not returnable.

DAMAGED SHIPMENTS / SHORTAGES

All shipments are F.O.B. origin, and title transfers to the purchaser once shipment is initiated.

Claims for damage or shortages must be made directly with the carrier at the time of delivery. To facilitate
claims:

• Note damage on the bill of lading upon delivery
• Request an inspection from the carrier promptly

Any shipment shortages must be reported to estimatedwebsite Performance Inc. in writing within five (5) business days of receipt.

Claims must include:

• Order number
• Invoice number
• Invoice date
• Shipment date
• Part number(s)
• Description
• Carton count

PRODUCT SUBSTITUTION / GENERAL INFORMATION

estimatedwebsite Performance Inc. reserves the right to substitute products or materials of equal or greater quality at its discretion.

Specifications, product information, and pricing are subject to change without notice. While all data has been compiled carefully, estimatedwebsite Performance Inc. assumes no responsibility for errors or omissions.

Certain products may not be legal for sale or use in some states (including California) on pollution-controlled vehicles. It is the purchaser’s responsibility to ensure compliance with local laws and regulations.

WARRANTY / DISCLAIMER

estimatedwebsite Performance Inc. warrants its products to be free from defects in materials and workmanship for three (3) years from the date of sale to the original purchaser.

This warranty does not apply to defects resulting from:
• Improper or abnormal use
• Negligence
• Accidents
• Improper installation or maintenance
• Unauthorized repair or modification

Liability under this warranty is limited solely to repair or replacement of defective products, at the sole discretion of estimatedwebsite Performance Inc.

estimatedwebsite Performance Inc. shall be the sole judge of warranty claim validity.

LIMITATION OF LIABILITY

Incidental and consequential damages are not recoverable under this warranty. Some states do not allow such limitations, so this exclusion may not apply to you.

This warranty provides specific legal rights; additional rights may vary by state.

WARRANTY CLAIM PROCEDURE

To obtain warranty service:

• Return the defective product with an RMA number
• Include proof of purchase within the past three (3) years
• Clearly label each item with the part number and defect description

Products covered under warranty will be returned via ground shipping at the company’s expense. Expedited shipping is the customer’s responsibility

INDEMNIFICATION & USE DISCLAIMER

Buyer acknowledges that all products are subject to varying conditions based on installation and use. estimatedwebsite Performance Inc. does not control or fully understand the specific applications of its products.

Buyer agrees to defend, indemnify, and hold harmless estimatedwebsite Performance Inc. from any claims, damages, losses, or expenses (including legal fees) arising from:

• Product use or misuse
• Improper application
• Failure to determine suitability

Except for the limited warranty stated above, estimatedwebsite Performance Inc. shall not be liable for any claims, damages, or injuries arising from product use.

Motorsports and related activities are inherently dangerous.

No warranty or representation is made regarding the product’s ability to protect users from injury or death.

The user assumes all associated risks.
